1. GENERAL

Welcome to Aravrit, an online shop providing diverse crafted items and operated by Ms. Liron Turkenich (licensed dealer no. 039811963) (the “Products” and “Liron” respectively).

Please read the following terms and conditions of use (the “Terms of Use” or the “Agreement“) carefully before accessing or using Aravrit’swebsite (the “Site“). This Agreement in conjunction with the Privacy Policy and other terms and conditions/policies which may be posted on the Site, constitute a legal agreement that governs your use of the Site.

For the purpose of these Terms of Use, Aravrit shall be deemed the administrator of the Site, for all intents and purposes.

Aravrit reserves the right to vary these Terms of Use at any time at its sole discretion. Upon posting any updated Terms of Use, it shall become immediately binding. By accessing and/or using the Site you agree to be legally bound by these Terms of Use and to any changes thereto. You are advised to review these terms of use on a regular basis as you will be deemed to have accepted variations if you continue to use the Site after they have been posted.

You are only authorized to use the Site if you agree to abide by all provisions specified in this Agreement.

If you do not agree with these Terms of Use, please exit the Site and refrain from using it furthermore.

By giving your consent to these Terms of Use together with the Privacy Policy, you acknowledge, approve and confirm that you have read and understood these Terms of Use together with the Privacy Policy, and you accept and agree without limitation or qualification to be bound by both of them.

2. ELIGIBILITY

Placing orders through the Site is only permissible if you are 18 years old or older, or are at the legal age permitted in one’s jurisdiction to form a binding contract.

If you are under the age of 18 or the applicable legal age in your jurisdiction, you can only use the Site in conjunction with, and under the supervision of, your parent or guardian who has agreed to these Terms of Use.

By using this Site, you represent and warrant that you have the right, authority, and capacity to enter into these Terms of Use and to abide by all of the terms and conditions set forth herein.

3. USE OF THE SITE; LICENSE

The use of the Site is not and shall not be deemed as a sale, transfer or assignment of any rights in or to the Site. Aravrit hereby grants you a personal, non-exclusive, limited, revocable license to receive updates regarding Aravit’s Site and purchase Aravrit’s Products through the Site, subject to the provisions of these Terms of Use (the “License“).

The rights granted herein are subject to your continuous compliance with the provisions of these Terms of Use. Without prejudice to any other rights and remedies Aravrit may have hereunder, any non-compliance, which shall be determined at Aravrit’s sole discretion, entitles it to deny you further use of the Site or purchase the Products.

All rights not expressly granted to you herein are reserved by Aravrit. Aravrit retains all rights, titles and interest in and to the Site and the Products, including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, titles, computer codes, audiovisual effects, themes, characters, character names, fonts, typefaces, stories, dialog, settings, artwork, sound effects, musical works, and moral rights whether registered or not and all applications thereof.

Unless expressly authorized by mandatory applicable legislation, or by consent of Aravrit (in accordance with applicable law) you will not, without Aravrit’s prior written consent: (i) commercially exploit the Site other than using it as intended, under these Terms of Use; (ii) distribute, lease, sub-lease, license, sell, resell, rent, lend, convey or otherwise transfer, dispose or assign the Site, or any copies thereof, or any passwords or usernames associated with the Site, (iii) copy, reproduce or distribute the Site in any manner or medium, in whole or in part, or decompile, disassemble, or reverse engineer the Site by any means whatsoever; (iv) cause the Site or the Products to be publicly available or available on a network for use or download by users not otherwise registered to the Site in accordance with the provisions hereof; (v) use the Site (or permit others to do the same) on a network, for on-line use, (vi) remove, alter, or obscure any product identification, copyright, intellectual property, author attributions, legal notices or other labels of the origin or source in the Site, (vii) alter, modify, enhance, or create a derivative work of the Site or the Products.

Aravrit hereby grants you the access to the Site solely for the purpose of personal use and not for any commercial use or use on behalf of any third party. For special wholesale requests please contact us at: hello@aravrit.com.

Any breach of this Agreement shall result in the immediate revocation of the License granted to you under this Section ‎3 without prior notice.

4. REGISTRATION PROCESS

During the registration process, your personal information will be collected and saved on Aravrit’s servers under the provisions of the Israeli Protection of Privacy Law, 5741-1981 (the “Law“).

By registering as one of Aravrit’s users in order to receive Aravrit’s updates, newsletters, notifications regarding “back in stock” products or purchase the Products, you certify that the information you provide on the registration form is accurate and pertains only to you. You are and shall remain solely responsible for maintaining the confidentiality of your credentials you have chosen during the registration process to Aravrit.

Aravrit reserves the right to deactivate or suspend your account and/or your ability to make use of the Site for any reason, at its sole and absolute discretion.

As part of the registration process for our newsletters or notifications for when products are in stock, you will be asked to provide your name and your email address.

Please note that Aravrit may, at its sole discretion reject or deny your registration to the Site if it deems that such registration is associated with fraudulent activity, competitive activity or for any other reason it is found, in good faith, as malicious or offending.

By registering to the Site and accepting these Terms of Use, you explicitly agree to receive e-mail notifications from Aravrit or any other notification of any kind and sort, regarding new updates and opportunities offered by Aravrit (including, our newsletter, “back in stock” alerts and other notifications we may send you from time to time). You may opt out of receiving any newsletter or other communication by Aravrit by unsubscribing via the designated link on the applicable notification previously received. 5. PRICE AND PAYMENT

All prices associated with the Products are final prices that include VAT and are true and correct at the time of entering the Site. For such customers who are exempt from VAT payment under applicable law, we will also specify the Products’ prices excluding VAT.

In the event Aravit is not able to ship the ordered Product, the value of the items which have not been shipped will be refunded to your original method of payment.

All prices are exclusive of delivery charges. The total cost of the order is the price of the Products ordered in addition to the applicable shipping and handling charges, as shall be specified on the final order page. Please be advised that the rate of delivery charges derives from your preference of the shipping method, as can be chosen by you on the final order page.

Prices may change at any time, provided however, that such changes shall not affect confirmed orders for which Aravrit has sent an order confirmation.

Once you have selected all items you wish to purchase, they will automatically be added to your shopping cart. In order to process the order and make the payment, you will either have to own a Paypal account or alternatively submit your credit card details.

Aravrit neither saves your credit card details nor registers them in any database held by Aravrit.

By providing your personal and credit card details, you are confirming that the credit card used for processing the payment belongs to you. Credit cards are subject to verification and authorization by the card issuing entity. In the event the applicable entity does not authorize such payment, Aravrit shall not be liable for any delay or failure to deliver of the Products.

Only upon the approval of the payment by Paypal or the applicable credit card issuing entity, will Aravrit be obligated to fulfill the order and supply the Product/s.

6. SHIPPING & DELIVERY

Aravrit ships to almost every country in the world. If you are not sure whether we can ship the Products to your country of residence, feel free to contact us at hello@aravrit.com.

All orders are shipped via the Israel Postal Company. Please allow 2-4 business days for orders to be processed after your purchase is complete and order confirmation has been received. For the avoidance of any doubt, the day on which the order has been placed and confirmed shall not be included in the processing period specified above.

Delivery Dates and Prices:

Domestic shipping to a pick-up location (epost): up to 5 business days – 12 NIS

Shipped as epost and arrives at various pick-up locations. You will receive an SMS message and an email once your package was collected with a tracking number which will allow you to check the status of your order (here). You will receive another text message when your package has arrived to the pick-up location. In some cases, your package will be shipped to a nearby location. This will be decided by the delivery company based on traffic and space. (you will get a notification from where to pick it up)

Domestic shipping to your doorstep: up to 3 business days – 25 NIS

Shipped via a delivery company and arrives at your home. You will receive an SMS message and an email once your package was collected and another to notify you that the courier is on the way. The courier will call you to make sure you are home to accept the package.

* Ceramics will be shipped at 35 NIS.

Worldwide standard shipping: up to 10 business days – 5 USD

(Australia and Hong Kong up to 14 business days)

Worldwide express shipping : up to 4 business days – 39 USD

Once your order has been shipped, we will send you a confirmation e-mail with a tracking number.

Important Notice: In the event you are notified of the arrival of a shipment sent by Aravrit, and despite such notification(s) from the applicable postal company, you refrain from collecting your package, such package will be automatically returned to Aravrit. Under such circumstances, any cost associated with an additional shipment of said package, should a request for such shipment be made, will be borne by you.

Aravrit shall not be held liable for any delays in the shipment and delivery dates that occur pursuant to events or actions not under Aravrit’s control, including pursuant to delays in customs, strikes, disasters, pandemic etc. (i.e: force majeure).

7. RISK OF LOSS

Delivery to courier shall constitute delivery to you, therefore any risk of loss or damage shall not be under the responsibility of Aravrit.

Any claim relative to damage during shipping or delivery should be made directly to the courier. Any claims against Aravrit for shortage or damage occurring prior to such delivery to courier must be made within 14 (fourteen) days after receipt of the ordered Products and accompanied by original transportation bill signed by courier noting that courier received the ordered Products from Aravrit in the condition claimed.

8. CANCELLATION POLICY

You may cancel your order in accordance with the provisions of the Consumer Protection Law, 5741 – 1981 (Hereinafter: the “Law”) within the later of : (i) thirty (30) days following the date on which you complete your order, or (ii) thirty (30) days following the date on you have received confirmation to your order, provided in each case the Products, if already been received, are in new condition (unworn and unwashed).

A cancellation notice (hereinafter: a “Cancellation Notice”) should be provided by you to Aravrit in accordance with the above provisions, and shall specify your name, identity number and your order number, and in the event the Cancellation Notice was provided orally – additional identification details as agreed between you and Aravrit, may apply.

You are required to provide the Cancelation Notice via one of the following methods, promulgated by law:

Orally over the telephone; or
In an oral notice at the business venue; or
By registered mail; or
By electronic mail; or
Over the internet (through a designated link).

In the event the Cancellation Notice date is given on a holiday in Israel, then the cancellation day will be considered the first day of business thereafter.

Whereupon a Cancellation Notice is given, not pursuant to a defect or a non-conformity of the Product ordered, you will be charged a cancellation fee, pursuant to the provisions of the Law, which shall equal the lower of: (i) 5% of your ordered Product price; or (ii) NIS 100 . In the event the reason for cancellation relates to a defect or a non-conformity within the definitions provided by Law, you will not be charged the cancellation fee. The shipping costs of returned items, not due to a defect or a non-conformity shall be borne by you.

9. NO UNLAWFUL OR PROHIBITED USE

You may not use the Site for any purpose that is unlawful or prohibited by applicable law or by the Terms of Use provided herein, or interfere with any other user’s use of the Site.

You may not attempt to gain unauthorized access to the Site or any part thereof, or the computer systems or networks connected to any of Aravrit’s servers through any means.

You may not obtain any materials or information through any means not intentionally made available to you through the Site.

10. FEES AND COSTS

Unless indicated otherwise, the use of the Site is free of charge.

11. TERM AND TERMINATION

Unless set out otherwise by Aravrit, the term of the License shall commence on the date that you start to use the Site, and shall lapse on the earlier of: (i) the date on which the term set by Aravrit terminates; or (ii) the date you stop using the Site, or (iii) your attempt to circumvent any technical protection measures used in connection with the Site, or (iv) your use of the Site is in breach of these Terms of Use, or (v) Aravrit decides to terminate your engagement and use of the Site and to revoke any and all rights previously granted to you in connection with the License.

Without limiting Aravrit’s statutory rights to terminate or Aravrit’s other rights and remedies, Aravrit is authorized to suspend the fulfillment of the obligations or to dissolve the License granted to you without incurring any liability for compensation in the event:

a) That you fail to fulfill your obligations to Aravrit, whether in full or in part;

b) Aravrit discovers that you do not use the Site in accordance with these Terms of Use;

c) Aravrit receives complaints in respect of your use of the Site;

d) Aravrit becomes aware of circumstances that constitute valid grounds to expect that you will not timely fulfill your obligations as provided in this Agreement;

Under no circumstances shall Aravrit become liable in any way if false complaints or wrong judgment of your behavior, leads to suspension of your use of the Site.

Promptly upon termination, you must cease all use of the Site and you shall not be entitled to place any orders on the Site.

Aravrit may retain copies of contents you provided to it as part of your use of the Site, where it has an overriding legal interest which requires it to preserve such copies, for example for the purpose of legal disputes or in order to comply with any order or writ issued by a competent court or governmental authority. Any reservation of your personal information and details will be subject to our Privacy Policy.

12. DISCLAIMER; LIABILITY; INDEMNIFICATION

Your use of the Site is at your own account and risk. You are responsible for any and all use of the Site, as well as for the integrity of the identifying means in respect of your account.

Aravrit is neither responsible nor liable for any loss that results from the unauthorized use, with or without your knowledge, of your identifying means.

You agree and warrant that your use of the Site will not infringe upon any and all rights of third parties, including but not limited to intellectual property rights, moral rights and privacy rights and, more specifically, that such use will always be in conformity with all applicable laws and regulations and with the professional standards in respect of data protection and confidentiality.

You hereby agree to defend, indemnify and hold the owner of Aravrit, its employees, consultants and affiliates, harmless from and against all damages, claims, costs, charges and expenses (including attorneys’ fees) arising out of your use of the Site.

You must notify Aravrit immediately in the event you become aware of any access to or usage of the Site by third parties under your credentials which you have not authorize or any other possible breach in security.

Aravrit cannot guarantee that the Site will always be available or will always work without any interruptions, errors or defects, or that the information provided on the Site is complete, correct, accurate and/or up-to-date.

The Site and the Products are provided to you ‘as is’ and may include defects. Aravrit shall not be held liable for any typos specified in the Products’ name or description which do not materially mislead the user as to the actual description or title of the Product. The Products are provided without warranty of any kind, without performance assurances or guarantees of any kind, and your use is at your sole risk. Aravrit and its affiliated parties do not make, and disclaim, any and all express or implied warranties, including implied warranties of condition, error-free or uninterrupted use, accuracy of data, merchantability, compatibility, interoperability, satisfactory quality, fitness for a particular purpose, non-infringement of third party rights or that any errors or defects on the Site and/or the Products will be corrected.

Aravrit at all times has the right, but can never be obliged, to update, to upgrade and/or to adapt the Site and/or to change or remove data or information stored on the Site.

The images shown on the Site are for illustration purposes only. Differences between such images and the actual Products may apply.

YOUR USE OF THE SITE IS AT YOUR OWN RISK. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS, NEITHER THE OWNER OF ARAVRIT, NOR ANY OF ITS AGENTS OR ANY OTHER PARTY INVOLVED IN DEVELOPING THE SITE OR THE INTELLECTUAL PROPERTY EMBEDDED IN THE PRODUCTS, ARE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE (A) OR THE INABILITY TO USE OF THE SITE, (B) OF THE SERVICES PROVIDED THORUGH THE SITE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. THIS INCLUDES BUT IS NOT LIMITED TO THE LOSS OF DATA OR LOSS OF PROFIT, EVEN IF IT WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In any event, Aravrit’s aggregate liability for any damage of any kind and sort shall not exceed the value of the specific Product causing the applicable damage.

13. INTELLECTUAL PROPERTY

All text, graphics, photographs or other images, button icons, fonts, typefaces, audio clips, logos, slogans, trade names or word software and other contents on the Site or on the Products available on the Site, belongs exclusively to Liron or its appropriate content suppliers. You may not use, download, reproduce, copy, modify, transmit, display, publish, sell, license, publicly perform, distribute or commercially exploit any of the content or otherwise dispose of any of the content in a way not permitted by Liron. The use of data mining, robots, or similar data gathering and extraction tools on the Site as well as the use of Aravrit’s trademarks or service marks is strictly prohibited. You may view and use the content only for your personal information and for shopping and ordering on the Site and for no other purpose. The collection, arrangement, and assembly of all content on the Site belongs exclusively to Liron. You may not use Liron’s content in any manner that is likely to cause confusion or violation of any applicable laws or regulations. All software used on the Site is the property of Liron and/or its software suppliers.

14. CONFIDENTIALITY

Aravrit shall keep confidential any and all of your shared personal details (if any). Aravrit shall only be allowed to make use and access your details for so long as you grant Aravrit the right to do so and such grant of right has not been revoked by you, in accordance with Aravrit’s Privacy Policy.

You may, at any time, disconnect from the Site, thereupon no updates or other notifications will be sent to your email address.

Notwithstanding the aforesaid, any notes, copies and/or derivative information may only be used by Aravrit for overriding legal obligations (such as legal disputes, abiding a court order etc.)

15. DATA PROTECTION AND PRIVACY

Aravrit highly regards your rights in your personal data and your privacy. The collection and use of your data is subject to Aravrit’s Privacy Policy and is performed according to all applicable laws and regulations.

16. SURVIVAL AND SEVERABILITY

Any provisions in these Terms of Use, which by their nature extend beyond the termination or expiration of any License under these Terms of Use, will remain in effect after such termination.

If any provision of these Terms of Use is deemed to be void, invalid, unenforceable or illegal, the other provisions shall continue in full force and effect. In case of any such invalid provisions, Aravrit will replace such invalid provisions.

17. LAW AND JURISDICTION

These Terms of Use and your use of the Site are governed by the laws of the State of Israel.

The courts of competent jurisdiction located within the District of Haifa, Israel, will have the exclusive jurisdiction over any and all disputes arising out of, relating to or concerning these Terms of Use and/or the Site or in which these Terms of Use and/or the Site are a material fact.

18. USER COMPLAINTS AND QUESTIONS

You hereby agree to bring any and all complaints regarding the Products to Aravrit as soon as possible in order to provide Aravrit with the opportunity to address such complaint properly and to resolve any outstanding issues. Aravrit assumes no liability for complaints that are not properly brought to the attention of Aravrit with sufficient notice for it to resolve or attempt to resolve.
